1. Agreement to Terms

By accessing or using EloquentPro ("Service") at eloquentpro.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

EloquentPro is an AI-powered platform that helps users practice and improve their communication skills through:

  • Mock interview practice with AI interviewers
  • Presentation Q&A practice
  • Pitch practice for investors
  • Negotiation simulation
  • Difficult conversation practice
  • Speech analytics and feedback

3. User Accounts

3.1 Account Creation

To use certain features of our Service, you must create an account. You can sign up using Google OAuth. You are responsible for maintaining the security of your account.

3.2 Account Requirements

  • You must be at least 16 years old to use the Service
  • You must provide accurate and complete information
  • You are responsible for all activity under your account
  • You must notify us immediately of any unauthorized use

3.3 Account Termination

We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us.

4. Subscription and Payments

4.1 Free Tier

We offer a free tier with limited features (2 practice sessions per month). No payment is required for the free tier.

4.2 Paid Subscriptions

We offer paid subscription plans with additional features. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the renewal date.

4.3 Refunds

Refund requests are handled on a case-by-case basis. Contact us at contact@eloquentpro.io for refund inquiries.

5. User Content

5.1 Your Content

You retain ownership of content you upload to the Service (resumes, job descriptions, presentations). By uploading content, you grant us a limited license to process it for the purpose of providing the Service.

5.2 Content Restrictions

You agree not to upload or share content that:

  • Is illegal, harmful, or violates others' rights
  • Contains malware or malicious code
  • Infringes on intellectual property rights
  • Is fraudulent, deceptive, or misleading
  • Harasses, threatens, or discriminates against others

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate at our sole discretion.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated tools to access the Service without permission
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the Service without authorization
  • Use the Service to build a competing product
  • Share your account credentials with others

7. AI-Generated Content

7.1 Nature of AI Responses

Our Service uses artificial intelligence to generate interview questions, feedback, and other content. AI-generated content:

  • Is for practice and educational purposes only
  • Should not be considered professional advice
  • May not always be accurate or appropriate
  • Does not guarantee job interview success

7.2 No Guarantees

We do not guarantee that using our Service will result in job offers, successful negotiations, or improved performance. The Service is a practice tool only.

8. Intellectual Property

8.1 Our Property

The Service, including its design, features, code, and content (excluding user-uploaded content), is owned by EloquentPro and protected by copyright, trademark, and other intellectual property laws.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • The results from using the Service will meet your expectations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELOQUENTPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless EloquentPro and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
